General Chairman John Reynolds has assigned Division 209 Local Chairman Richie Staffen (Green Bay) and I the
task of investigating the three grievances your Division has filed for our General Committee to resolve. Mr. Staffen
and I were selected for this task because the Divisions we represent on the Committee have little to no stake in the
outcome of the grievances. We will not ultimately be ones who rule on your Division's grievances. Our task is to
gather information and compile a report to present to the General Committee. The entire Committee as a whole will
then review this report and make a ruling on your issues when we convene in May. Your Division can be confident that
I will remain completely neutral during this information gathering and reporting process.
I am in possession of your Division's minutes from your March 12, 2009 meeting. If I understand these minutes
correctly, your Division is petitioning the General Committee to rule on the following three items pertaining to Article 7,
Section 3(B) of the current February 1, 2009 Wisconsin Central BLET Agreement (CBA):
1. Changing Chippewa Falls from District 5, Terminal 6 to District 4, Terminal 3.
2. Adhering to the current CBA by making Waupaca District 4, Terminal 1 covered by Stevens Point
engineers.
3. Changing Taylor District 4, Terminal 2 to District 4, Terminal 1.
Your Division is being given an opportunity to submit pertinent information on its behalf to help substantiate the
Division's positions on the above three issues. I will also be attempting to contact the Local Chairmen of other
Divisions who may be directly affected by the outcome of your petition. They will be afforded the opportunity to submit
information on their Divisions behalves as well. Any information submitted for the report should be given to me. I
recommend that your Division take advantage of this opportunity and submit information to help support your
requests. Examples of the information your Division may want to submit to me can include items such as current and
past CBA articles, previous claims, call sheets, etc. I prefer that anyone who wants to submit information to help
support these grievances do so with documentation and/or in writing. Submitting information to me verbally does not
constitute very reliable evidence and is difficult to document in the report that is to be reviewed by the members of the
General Committee.
Please note that your Division is the moving party in this petition. It is the responsibility of your Division to provide
information to help support the grievances in your petition. It is not the responsibility for me or anyone else on the
General Committee to research and gather information on your Division's behalf. The information your Division
provides will be put into a report to be reviewed by the Committee. The Committee will then use the information your
Division provides to make a final ruling.
The General Committee will meet for business on May 10th. This does not give much time for your Division to gather
and submit information. Any information submitted on your Division's behalf must be submitted and received by me no
later than May 7th. Information received after this date may not be included in the report. The reason for this
deadline is to allow me time to put the information in the report for the meeting.
