Please read and familiarize yourself with the policy and note that SDV's have restrictions placed upon them. Make sure you are familiar with these restrictions prior to deciding on whether or not you desire to break up any solid vacation blocks into SDV's. Also be aware that only a maximum of two weeks of solid vacation will allowed to be broken up into SDV's. This policy is the policy that our membership agreed to at our last Division meeting which addressed this topic. Anyone who wants to break up any solid weeks of vacation this year into individual SDV's must make this decision prior to the ending date of March 15th, 2009. Beyond this date, no one will permitted to break up any solid weeks of vacation for 2009. This date was also agreed and voted on at our last Division meeting. I have designated Brother Ray Weart to handle the scheduling of all vacation and PLD's. Anyone wishing to schedule, change, or cancel any PLD's, SDV's, or solid vacation weeks should contact him. Also be advised that today, February 16th, is President's day. This is a holiday under our current Collective Bargaining Agreement. Anyone who works today is entitled to 1.2 rate for the first 10 hours of service. Normal 1.5 rate of pay will apply for all hours worked over 10. You must enter a code at the bottom of your tie-up screen on the CATS System in order to get this rate. You must also be available for work 2 days prior and 2 days after this date to be paid the Holiday rate. Have the conductor you worked with show you how to put in this information on the tie-up page (I believe the only Holiday code that will work at Schiller is 096). | February 17, 2009 Brothers of Division 184: I will start immediately scheduling SDV’s for 2009. Since we are starting this after the original vacations were scheduled, I will NOT cancel any vacation weeks to be used as SDV’s after March 15, 2009 as was agreed upon at the Division 184 meeting February 11, 2009. You must advise me before March 15 which weeks (Up to two) you will want to break up. I will continue to schedule all PLD’s and SVD’s for our division. Please do NOT fax anything to CMC for and PLD or SDV days you want as doing so will delay your ability to schedule these days assuming the slots are open. If I can schedule you for a PLD or SDV, I must fax in the form to CMC authorizing the PLD-SDV you want to schedule. However, when using a solid block of vacation, it will still be the responsibility of the Engineer taking a solid week’s vacation to fax in the confirmation form to CMC as we’ve done in the past. Please e-mail me any PLD-SDV requests to me at wchogger@earthlink.net and remember that any cancellations of PLD’s or SDV’s must also come through me. Also, please note that I will attempt to schedule PLD's and SDV's with less then 48hrs notice but you run the risk of CMC disallowing the PLD or SDV on such short notice. Ray Weart 1st L.C. Center Street Harvey, IL 60426 Dear Mr. Cary, This letter is in reference to an Assistant Superintendent's Notice, dated October 12, 2009, for the Schiller Park Terminal that was issued to abolish two regular assignments effective 1400 on October 13, 2009. The two assignments this notice abolished were assignment MK 2000 and assignment Relief 1. On the same day, another Assistant Superintendent's Notice was issued for the Schiller Park Terminal abolishing assignment SP 1400 effective at 2359 on October 20, 2009. This second notice also re-established assignment SP 1400 with different rest days. This notice also re-established assignment Relief 1 back with a different work schedule. These two regular assignment additions were to be effective at 0001 hours on October 21, 2009. Overall, these two notices permanently abolished assignment MK 2000 and abolished assignment Relief 1 for a week. It also downgraded the assignment SP 1400 from Saturday and Sunday rest days to Sunday and Monday rest days. Assignment MK 2000 was abolished permanently. This assignment had been a WC assignment for many years. This assignment went on and off duty at Markham Yard and handled train Q119 from Markham to Schiller Park. This train handled both intermodal and freight cars. I was informed the new CN operating plan involved taking the intermodal cars traditionally handled on train Q119 and putting them on train Q199. The freight cars that were handled by train Q119 are now being put on a separate all freight train called a 419 type train. I was also informed that the new 419 type train will operate from Markham to Schiller Park with GTW or IC crews. Chicago Implementing Agreement II B states the following: "Work currently bulletined at existing yards within the Chicago Terminal will continue to be work that will be advertised to employees at those locations, e.g. assignments at Schiller Park will continue to be advertised to employees at that location. The same requirements also apply at Markham, Elsdon, Glenn, and Hawthorne. It is not the intent of this Agreement to transfer, on a permanent basis, work from one property to another”. Chicago Terminal Implementing Agreement VI. (General) states the following: “During discussions leading to this agreement, the organization raised concerns regarding the distribution of work within the Chicago Terminal. While the Company fully intends to utilize the flexibilities afforded it under the STB Transaction, every effort will be made to minimize any adverse impact on employees of each respective property”. “In accordance with Section II B. of this Agreement, it is the intent that work will continue to be distributed in the same manner to the former IC/CCP, WC and GTW as it was prior to the implementation of this Agreement. Should a problem arise it will be handled in monthly discussions between the General Manager and the respective Local Chairmen with a view towards maintaining a ratio of assignments, so far as it is practicable, as they exist today, without impeding operational efficiencies of the Company’s operation. Any issues that remain unresolved as a result of these discussions may be elevated to the Labor Management Committee for final resolution”. Prior to this Agreement, WC employees were assigned all work that operated directly from Markham Yard to Schiller Park. Reclassifying freight and changing train names does not allow the CN to reassign work that belonged to one group of employees to another. This Agreement states that every effort will be made to minimize any adverse impact on employees of each respective property. It also states work will continue to be distributed in the same manner to the former IC/CCP, WC and GTW as it was prior to the implementation of this Agreement. Based on this Agreement, it is the opinion of this Organization that the work abolished by these Assistant Superintendents' Notices should remain work that is assigned to WC employees. Reassigning this work to GTW or IC employees is a violation of this Agreement resulting in the loss of an assignment and work. This work loss is having an adverse impact on your WC employees. BLET General Chairman John Reynolds and I would like to formally request a meeting with you to discuss this issue in accordance with the Chicago Terminal Implementing Agreement. Hopefully, we can reach a mutual agreement or compromise regarding this topic that avoids the filing of time claims and/or other grievances. Mr. Reynolds and I both look forward to meeting you for the first time and hope to develop a good working relationship with you. We are confident we can work out this issue as well as others that arise in the future in a manner that is favorable to both this Organization and the CN. | POSTED MAY 17, 2010 Gentlemen, It has been brought to my attention that CN Managers are closely monitoring tie-up times on crews. I have now heard of three instances in the last couple of days where a CN Manager has phoned a train crew member to get specific information about their crew's tie-up time. Train and taxi arrival times are being audited and compared with tie-up times. Crew members are being asked questions about what activities and delays they had between the time they arrived at a terminal and the time they actually showed clocking out. I believe these audits are being done on crews daily. I have reason to believe that we are all being monitored much more closely than we have in the past. This is probably a result of the recent attack on eliminating overtime. WE ARE ALL BEING WATCHED!! In order to avoid any potential charges on this matter, I would recommend that all crews be prompt in tying-up after completing their tours of duty. Complete your required tasks and tie-up as requested by a manager. If you are tying up at a location without a CATS System, make sure you phone in your end of tour time promptly. Don't wait to call and retro your tie-up time. Crews doing this are being questioned as to why they are not showed off duty in the CATS System. It has been brought to my attention that some individuals are tying-up on their own accord without getting direct authority to end their tour of duty by a manager. I strongly recommend that anyone doing this cease this behavior immediately. Unless you have expired on your federal hours of service, I wouldn't clock out without a manager's authority. This is a serious offense that may lead to your termination. I know here at Schiller it can be frustrating trying to contact a manager for tie-up authority when you want to go home. However, this is less frustrating than being unemployed. Remember, each crew member is responsible for his/her own tie-up. I encourage everyone to clock out while they are present to insure they are tied-up at the proper time. If you leave allowing another crew member to tie you up, you may be placing your employment future in their hands. Be cautious. Big Brother is watching.
